- Ensure that the household's records belong to or are in the lawful custody of the household.
7. Confidentiality
Threadkin and its team members treat all information encountered during a session as strictly confidential. All team members are bound by confidentiality agreements. We will not disclose, discuss, or reference the contents of any document observed during a session to any party outside the household, except as required by Malaysian law.
8. Intellectual Property
All content on the Threadkin website — including text, images, and design — is owned by or licensed to Threadkin. You may not reproduce, distribute, or adapt this content for any purpose without our written permission. The session summaries and catalog documents produced for your household belong to you.
9. Disclaimers
Our services are organisational in nature. We do not provide legal, financial, or archival advice. The session summary and catalog we produce are for your household's personal reference only and do not constitute professional records management, legal documentation, or any form of certification. We do not represent that the organisation of your records will satisfy any third-party requirement.
10. Limitation of Liability
To the extent permitted by Malaysian law, Threadkin's total liability to you in respect of any claim arising from our services shall not exceed the total fee paid for the specific service giving rise to the claim.
We are not liable for any indirect, consequential, or incidental loss, including loss of data or documents attributable to pre-existing condition, accidental loss during the session, or misidentification of a document by the client. We are not liable for delays caused by events outside our control, including but not limited to transport disruption, illness, or natural disaster.
11. Indemnification
You agree to indemnify and hold harmless Threadkin and its team members from any claim, loss, or expense arising from your use of our services, your breach of these Terms, or any false information provided in connection with a booking.
12. Termination
Either party may terminate a service agreement by providing written notice. For the Annual Maintenance Subscription, either party may give 30 days' notice of termination. Upon termination, we will refund the pro-rata value of undelivered visits. Sections relating to confidentiality, intellectual property, disclaimers, and liability survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to first attempt to resolve the matter informally within 30 days. If the matter is not resolved, it shall be referred to mediation through the Kuala Lumpur Regional Centre for Arbitration (KLRCA) before any court proceedings. The courts of Malaysia shall have exclusive jurisdiction.
